This agreement is to be used by students participating in any SLCC student travel. It outlines the responsibilities and expectations of those traveling members of any SLCC group.

By following the pre-approved agenda, this travel conduct agreement along with the policies and procedures of SLCC, you can potentially reduce personal liability and increase personal and group safety. 

NOTE: Only the student traveling may submit this form, others will be denied.

Student acknowledges that this Agreement contains, among other provisions, the following contractual terms: an assumption of risk, a covenant not to sue, a release of the student’s claims, and indemnification obligations. Student represents that Student is 18 years of age or older and is fully competent and authorized to sign this Agreement. In consideration for SLCC permitting Student to engage in Travel, Student, and its respective heirs, personal representatives, and assigns, agrees, as follows:

Conduct Expectations: Student understands that they are traveling as part of a College-sponsored program and they are a representative of the College during the entire event, program, activity, conference, and class trip. Student acknowledges that they have read, understand, and agree to abide with the travel guidelines. Student agrees that, under any circumstances of travel, including airline travel, Student will not volunteer their assigned seat in favor of being bumped to a later travel time. DURING THIS COLLEGE-SPONSORED TRIP, STUDENT AGREES THEY WILL NOT ENGAGE IN ANY INAPPROPRIATE OR ILLEGAL BEHAVIOR, WHICH COULD LEAD TO PERSONAL LIABILTY OR CHARGES OF UNETHICAL CONDUCT. Student will not engage in any illegal conduct in violation of the State of Utah law, the state or local jurisdiction laws, where the College-sponsored event is located, nor federal law. STUDENT AGREES THEY WILL NOT VIOLATE THE SLCC POLICY REGARDING ALCOHOL, DRUGS, SEXUAL CONDUCT, OR HARASSMENT, INCLUDING THE SLCC DRUG FREE WORKPLACE POLICY. Student affirms they have read, understand, and agree to abide by SLCC policies or the Student Code of Conduct. As a student-participant traveling on a College-sponsored function, student agrees to act responsibly at all times in a manner which is compliant with College policy, the law, and brings respect and honor to the College. Student understands the traveling College advisor/instructor is the responsible College agent for this trip. Student understands and acknowledges the advisor/instructor will make any final decisions regarding the safety and protection, changes to the planned agenda, and any other necessary decisions.

Assumption of Risk: Student represents that Student is qualified, in good health, and in proper physical condition to participate in Travel. Student acknowledges and understands that the Travel may include but is not limited to the following risks: pedestrian, airplane crashes, car, van, bus, boat, ferry, other transportation-related accidents, and drowning; natural disaster, political unrest; international or domestic terrorist incidents including bombings. Student acknowledges and understand that the Student may be exposed to certain risks that are inherent in participation in Travel. These risks may include but are not limited to such things as incidents related to the above-mentioned risks, including sprains, broken bones, cuts, bruises, entrapment, temporary or permanent disability, illness, personal injury, and/or death; adverse weather conditions; exposure to theft and other criminal activity; allergic reactions to food and drink items; other physical, mental, and emotional injury; other risks and dangers, whether known or unknown nor reasonably foreseeable. Student knowingly and voluntarily, accepts, and assumes responsibility for each of these risks and dangers, and all other risks and dangers that could arise out of, or occur during, Student’s engagement in the Travel. Covenant Not to Sue: Student agrees that it will not commence any legal action or lawsuit or otherwise assert any legal claim against SLCC or its trustees, officers, directors, employees, and agents seeking relief for any claim, whether or not such claim is released or waived under this Agreement. This provision shall survive the termination or expiration of this Agreement. Indemnification: Student agrees to indemnify and hold SLCC and its trustees, officers, directors, employees, and agents harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees, arising out of Student’s involvement in the Travel and to reimburse SLCC for any such expenses incurred. This provision shall survive the termination or expiration of this Agreement.

Release of Claims: Student releases and fully discharges SLCC, including its trustees, officers, agents, and employees, from any and all claims or causes of action that may be brought by Student, or by any other person (including but not limited to Student’s estate, family, successors, heirs, representatives, administrators, and/or assigns), including all liability for damage to personal property, personal injury or loss arising out of or related to Student’s engagement in the Travel to the fullest extent permitted by law. Student understands the College is not responsible for any damage to, theft, or loss of personal property. This provision shall survive the termination or expiration of this Agreement. Severability/Governing Law: Student agrees that this Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Utah and that if any portion hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. The Agreement shall be governed by the laws of the State of Utah, without regard to conflicts of laws principles. Venue for any lawsuits, claims, or other proceedings between the Parties relating to or arising under the Agreement shall be exclusively in the State of Utah. Health Insurance and Consent to Medical Treatment: Should Student require emergency medical treatment as a result of accident or illness arising during the Travel, Student consents to such treatment. Student acknowledges that SLCC will not provide health and accident insurance for Student, and Student agrees to be financially responsible for any medical bills incurred as a result of all medical treatment. Student understands that if they have no medical insurance coverage, they will be responsible for full-payment of any medical associated costs.

Likeness Release: Student authorizes SLCC, acting through its agents, employees, or representatives, to take photograph, video, and/or audio recordings of Student, including Student’s name, image, likeness, performance, and/or voice (“Recordings”). Student grants SLCC an unlimited right to reproduce, use, exhibit, display, perform, broadcast, create derivative works from, and distribute the Recordings in any manner or media now existing or hereafter developed, in perpetuity, throughout the world. Student agrees that the Recordings may be used by SLCC, including its assigns and transferees, for any purpose including but not limited to marketing, advertising, publicity, or other promotional purposes. Student agrees that SLCC will have final editorial authority over the use of the Recordings, and Student waives any right to inspect or approve of any future use of the Recordings. Student acknowledges that Student is not expecting to receive compensation for participating in the Recordings or for any future use of the Recordings. Student releases and fully discharges SLCC, and its employees, agents, and representatives, from any claim, damages, or liability arising from or related to Student’s inclusion in the Recordings or SLCC’s future use of the Recordings. This provision shall survive the termination or expiration of this Agreement.

Personal Travel: Student understands that activities or independent travel conducted when Student may have free time before, during, or after the scheduled Travel, shall be unsupervised by SLCC, its agents or employees. Student agrees that SLCC, its agents and employees, shall bear no responsibility or liability for any injury, damage or loss suffered by me during such periods of independent Travel or travel, and this Agreement shall remain in full force and effect during such times. Student agrees that in the event Student becomes detached from the group or is unable to remain with the group for any reason not within the control of SLCC, Student agrees to and will bear all responsibility and costs incurred to seek out, contact, and reach the group at its next available destination, or to return home. Student understands that if Student voluntarily leaves the Travel for any reason, including, but not limited to, illness, Student will be responsible for any and all costs associated with their return home, and that there will only be a refund, if appropriate, in accordance with SLCC policies.

Bacterial and Viral Diseases: Student understands and acknowledges the highly contagious nature of bacterial and viral diseases including, but not limited to the 2019 novel coronavirus disease (COVID-19) (collectively, the "Disease") and the risk that Student may be exposed to or contract the Disease, or other infectious diseases, by participating in the Travel. Student understands and acknowledges that such exposure or infection may result in serious illness, personal injury, permanent disability, death, or property damage. Student understands and acknowledges that this risk may result from or be compounded by the actions, omissions, or negligence of others, including college employees. Student understands and acknowledges that while the college has implemented preventative measures to reduce the spread of the Disease, the college cannot guarantee that Student will not become infected with the Disease, or other infectious diseases, while participating in the Travel and that participating in the Travel may increase Student’s risk of contracting the Disease. NOTWITHSTANDING THE RISKS ASSOCIATED WITH THE DISEASE, STUDENT ACKNOWLEDGES THAT STUDENT IS VOLUNTARILY PARTICIPATING IN THE TRAVEL WITH KNOWLEDGE OF THE DANGER INVOLVED. STUDENT AGREES TO ACCEPT AND ASSUME ALL RISKS OF PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE RELATED TO THE DISEASE, ARISING FROM PARTICIPATING IN THE TRAVEL OR ENGAGING IN ANY SIMILAR TRAVEL AT THE COLLEGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE COLLEGE OR OTHERWISE.

Acknowledgment: Student understands the legal consequences of signing this document, including (a) releasing SLCC and its trustees, officers, directors, employees, and agents from all liability on my behalf, (b) promising not to sue, (c) and assuming all risks of participation in this Travel, including travel to, from, and during the Travel. Student understands that they are responsible for their obligations and acts as described in this Agreement. Student agrees to be bound by the terms of this Agreement. Student affirms that they have read this three (3) page document, and that student is signing it freely and voluntarily. Student understands that if Student fails to comply with this Travel Conduct Agreement, Waiver and Release, and College policies that Student may be subject to College disciplinary actions outlined by SLCC Policies or Student Code of Conduct, and may result of loss of funding or reimbursement for expenses.
